4. CONCLUSION OF A CONTRACT

5. PAYMENT OPTIONS AND RETENTION OF TITLE

After the aforementioned payment period has expired, the entire invoice amount becomes due and default occurs automatically without a reminder.

In the event of default in payment, CLANDESTINO-SPIRITS.COM can commission a collection company in Germany or abroad or assign the claim.

In the event of default in payment by the customer, default interest of 14.9% per year and a reminder fee of a maximum of CHF 20 per reminder can be charged.

If a third party is commissioned with debt collection in the event of payment arrears, additional fees and costs according to the table of the ( VSI ) Association of Swiss Collection Trust Institutes (http://www.vsi1941.ch) may be incurred, which you expressly agree to.

The products delivered to the customer remain the property of CLANDESTINO-SPIRITS.COM until full payment has been made .

 

6. DELIVERY, OBLIGATION TO INSPECT, NOTIFICATION OF DEFECTS AND RETURNS
 
Deliveries are sent by post or courier service to the address specified by the customer in the order. Invoices are sent by email or post. With dispatch, the benefit and risk are transferred to the customer, as far as this is legally permissible.

If the delivery cannot be delivered or if the customer refuses to accept the delivery, CLANDESTINO-SPIRITS.COM can terminate the contract after notification of a complaint by email to the customer and setting a reasonable deadline and invoice the costs for the activities.

The customer is obliged to check the delivered goods immediately after receipt of the delivery and to report any defects for which CLANDESTINO-SPIRITS.COM guarantees immediately in writing by letter or email to the address in the legal notice.

Returns to CLANDESTINO-SPIRITS.COM are made at the expense and risk of the customer. The customer must send the goods in their original packaging , complete with all accessories and together with the delivery note and a detailed description of the defects to the return address given by CLANDESTINO-SPIRITS.COM in the imprint.

If the inspection by CLANDESTINO-SPIRITS.COM shows that the goods do not have any detectable defects or that these are not covered by the manufacturer's guarantee, CLANDESTINO-SPIRITS.COM can invoice the customer for the activities, the return or any disposal.

 

7. RIGHT OF WITHDRAWAL

The customer is granted a right of withdrawal for 14 calendar days after receipt of the goods. The customer must return the goods within 14 calendar days in their original packaging , complete with all accessories and together with the delivery note to the return address given by CLANDESTINO-SPIRITS.COM (Clandestino Specialties GmbH, Weststrasse 45, 8003 Zurich). Returns to CLANDESTINO-SPIRITS.COM are made at the expense and risk of the customer. Any payment that has already been made will be refunded to the customer within 20 calendar days, provided that CLANDESTINO-SPIRITS.COM has already received the goods back or the customer can provide proof of dispatch.

CLANDESTINO-SPIRITS.COM reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice the customer.

No right of withdrawal is granted in the following cases:

    • ( i ) If the contract has a random element, namely because the price is subject to fluctuations over which the provider has no influence.

    • ( ii ) If the subject of the contract is a movable object which, due to its nature, is not suitable for return or which can spoil quickly;

    • ( iv) If the contract relates to digital content and this content is not made available on a fixed data carrier or if the contract must be fulfilled in full by both parties immediately ;

    • ( v ) If the contract is about a service and the contract has to be fulfilled in full by the provider with the prior express consent of the consumer before the withdrawal period has expired.

    • ( vi ) In the areas of accommodation, transport, delivery of food and beverages and leisure activities, if the provider undertakes to provide the services at a specific point in time or within a precisely specified period of time.

 

8. NO SALE TO MINORS                                                                  

According to legal regulations, alcoholic beverages may not be sold to young people under the age of 16 in Switzerland , and spirits may not be sold to minors under the age of 18 .
